  1. The corresponding legal regulation may differ in detail from country to country, but may in principle read as follows:
    a) A conversation is initially considered “non-public” if it is not addressed to the general public and only heard from a limited group of people
    can be.
    b) Recording a non-public conversation without the consent of the conversation partner by using a recording usually violates the general right of personality, which protects the person in their own personal sphere of personality rights, and is a punishable offence.
    c) Making a sound recording of a non-public statement by another person available to a third party for whom it is not intended without the speaker’s consent or publishing such a recording is punishable, too.

A question at this point out of interest: What is the exact legal regulation for publishing sound recordings on which individual third parties can be heard and recognized without their explicit consent. This is clearly regulated for images (keyword “right to one’s own image”), but for sound recordings?

    • As it says on YouTube guidelines it’s not a GDPR matter as outside of EU. Let me know more what you understand how it works?
